AN ORDINANCE CLOSING AN ALLEY SITUATED IN THE BLOCK BOUNDED BY WOODROW STREET ON THE NORTH, CHAUTAUQUA AVENUE ON THE EAST, CO~IERCE STREET ON THE SOUTH AND BROAD STREET ON THE WEST. (S-76-3) WHEREAS, Surry Associates have made application to vacate, close and discontinue the hereinafter described portion of an alley situated in the block bounded by Woodrow Street on the north, Chautauqua Avenue on the East, Commerce Street on the South and Broad Street on the West; and WHEREAS, by resolution of this Council adopted February 24, 1976, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia (1950) as amended, to view the hereinafter described portion of the said alley and to report in writing whether in their opinion, any, and if any, what inconvenience would result from discontinuing the below described alley; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would sult from closing and discontinuing said alley. re- NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that that portion of said alley hereinafter described, be closed and vacated as an alley. Ail that certain piece or parcel of land situate in the City of Portsmouth, Virginia, being that portion of an alley 15 feet in width and approximately 100 feet in length; said alley lies to the south by the S.A.C.L. and Southern Railroad and ms situated in the block bounded by Woodrow Street on the North, Chautauqua Avenue on the East, Commerce Street on the South and Broad Street on the West. AND, BE IT FURTHER ORDAINED that the whole of the portion so closed shall be expressly subject to any easement reserved unto the City o~ Portsmouth for the construction, maintenance and repair of water mains, sewer mains, gas mains and storm drainage facilities.
