AN ORDINANCE CLOSING AN ALLEY SITUATED IN THE BLOCK BOUNDED <br />BY WOODROW STREET ON THE NORTH, CHAUTAUQUA AVENUE ON THE <br />EAST, CO~IERCE STREET ON THE SOUTH AND BROAD STREET ON THE <br />WEST. (S-76-3) <br /> <br /> WHEREAS, Surry Associates have made application <br />to vacate, close and discontinue the hereinafter described <br />portion of an alley situated in the block bounded by Woodrow <br />Street on the north, Chautauqua Avenue on the East, Commerce <br />Street on the South and Broad Street on the West; and <br /> <br /> WHEREAS, by resolution of this Council adopted <br />February 24, 1976, viewers were appointed pursuant to <br />Section 15.1-364 of the Code of Virginia (1950) as amended, <br />to view the hereinafter described portion of the said <br />alley and to report in writing whether in their opinion, <br />any, and if any, what inconvenience would result from <br />discontinuing the below described alley; and <br /> <br /> WHEREAS, the said viewers have reported in <br />writing that in their opinion no inconvenience would <br />sult from closing and discontinuing said alley. <br /> <br />re- <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of Portsmouth, Virginia, that that portion <br />of said alley hereinafter described, be closed and vacated <br />as an alley. <br /> <br /> Ail that certain piece or parcel of <br />land situate in the City of Portsmouth, <br />Virginia, being that portion of an alley <br />15 feet in width and approximately 100 feet <br />in length; said alley lies to the south <br />by the S.A.C.L. and Southern Railroad and <br />ms situated in the block bounded by Woodrow <br />Street on the North, Chautauqua Avenue on <br />the East, Commerce Street on the South and <br />Broad Street on the West. <br /> <br /> AND, BE IT FURTHER ORDAINED that the whole of <br />the portion so closed shall be expressly subject to any <br />easement reserved unto the City o~ Portsmouth for the <br />construction, maintenance and repair of water mains, <br />sewer mains, gas mains and storm drainage facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held March 23, 1976. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
