1976-42 <br /> <br />AI9 ORDINFuNCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY ADDING SECTIONS 6-29 THROUGH 6-31 <br />PERTAINING TO DEMOLITION OF BUILDINGS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Section 6-29 through 6-31 be added to <br />the Code of the City of Portsmouth to read as follows: <br /> <br />Section 6-29. Nuisance. <br /> <br /> It shall be unlawful and shall constitute a <br />~nuisance for the owner or occupant of any land or lot <br />in the City to permit any structure, house or dwelling <br />place thereon to be habitually kept or maintained in <br />such a manner as to be unsafe, unsanitary or otherwise <br />dangerous to human life, or which in relation to existing <br />use constitutes a hazard to safety or health by reason <br />of inadequate maintenance, dilapidation, obsolescence, <br />or abandonment. <br /> <br />Section 6-30. Notice to abate nuisence. <br /> <br /> Whenever the Building Official shall find any <br />structure, house or dwelling place or portion thereof to <br />be unsafe as defined in Section 6-29 of this Code, he <br />shall give the owner, agent for the owner or p~rson in <br />control of such building or structure, written notice. T~is <br />notice shall require the owner, agent for the o~ner or <br />person in control of such building within a stated time <br />to complete improvements or demolish or remove the building, <br />structure or portion thereof. <br /> <br />Section 6-31. Abatement by Building Official upon failure <br /> of owner to comply, etc. <br /> <br /> If an ov~er, agent for the o%~er, or person in <br />control of such buildings, fails, refuses or neglects to <br />comply with the notice of the Building Official as provided <br />in Section 6-30, the Building Official shall ascertain the <br />cost to demolish and remove said building, structure or <br />portion thereof, and shall cause such building, structure <br />or portion thereof to be demolished and removed from the <br />lot or property. The Building Official shall thereafter <br />transmit to the City Treasurer a statement of all costs <br />incurred, which costs shall be added to the taxes assessed <br />against real property on which the nuisance existed and <br />shall be collected with such taxes by any manner prescribed <br /> <br /> <br />
