AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY ADDING THERETO SECTION 38-96, PERTAINING TO FAILURE TO <br />CONNECT TO PUBLIC SEWER. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that the Code of the City of Portsmouth, Virginia, 1973, <br />be amended by adding thereto Section 38-96 to r~ad as follows: <br /> <br />Section 38-96. Failure to connect to public sewer. <br /> In the event the Public Health Director determines that <br />a public nuisance exist as a result of a building not being <br />connected to a public sewer which is operated and maintained in <br />accordance with a Certificate of Compliance issued under the pro- <br />visions of the State of Virginia Water Control Law, he shall <br />cause such public nuzsance to be abated. <br /> If the occupant or owner of such building fails to abate <br /> such public nuisance, the Director of Public Health shall authorize <br /> the Director of Public Utilities to do whatever ms necessary to <br /> abate same. <br /> <br /> All costs to the City incurred abating such public <br /> nuisance shall then be transmitted to the City Treasurer who <br /> shall docket such cost as a lien against such real estate in <br /> the Nuisance Abatement Lien Docket Book contained in the office <br /> of the City Treasurer, which lien shall exist until removed by <br /> payment of said expenses. <br /> <br /> Adopted by the Council of the City of ~ortsmouth, <br /> Virginia, at a meeting held October 12, 1976. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
