~-N ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 38-35 THEREOF PERTAINING <br />TO DISCRETIONARY REBATE OF CHARGES FOR WASTE. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia, that Section 38-35 of the Code of the <br />City of Portsmouth, Virginia, 1973, be amended ~o read as <br />follows: <br /> <br />Section 38-35. Discretionary rebate of charges for waste. <br /> <br /> Ail water for which a charge is made under <br />this Article passing through a meter shall be charged for <br />whether used, consumed or wasted; provided, however, that <br />Where underground or inside leaks or both occur in water <br />pipes, and the owner or occupant of such premises or the <br />consumer thereof, after receiving written notice of excess <br />consumption, shall have all necessary repairs made promptly, <br />shall furnish the director with either a plumber's letter <br />or a personal letter certifying that the repairs have been <br />made and the date completed, and shall have repairs in- <br />spected and approved by utility personnel, the director <br />may make such rebate to such owner~ occupant or consumer <br />in the amount in excess o~ the average quarterly bill the <br />last three quarters or the average monthly bill for the <br />las% three months bill. Only one adjustment credit may be <br />allowed for the same cause of waste within twelve (12) <br />consecutive months. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held August 24, 1976. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
