juries or death resulting to the person being arrested <br />if he had reason to believe that %he person being arrested <br />was pointing, or brandishing such firearm, or object which <br />was similar in appearance to a firearm, with intent to <br />induce fear in the mind of another. <br /> <br /> (c) For purposes of this section the word "firearm" <br />shall mean any weapon in which a~munition may be used or dis- <br />charged, by explosion, pneumatic pressure or spring mech- <br />anism. The word "~unition", as used herein, shall mean <br />cartridge, pellet, ball, missle or projectile adapted <br />for use in a firearm. <br /> <br />3. That Section 21-38 be amended to read as <br /> <br />follows: <br /> <br />Section 21-38. Carrying concealed weapons. <br /> <br /> (a) if any person carry about his person, hid from <br />common observation, any pistol, or any other firearm or <br />weapon designed or intended to propel a misste of any kind, <br />dirk, bowie knife, switchblade knife, razorr slungshot, <br />metal knucks, or any weapon of like kind, or nun chahka <br />or any other similar flailing instrument consisting of <br />two or more rigid parts connected in such a manner as to <br />allow them to swing freely, which instrument may also be <br />known as a "nunchuck" or "Nunchaku'~, shuriken, fighting <br />chain or any weapon of like kind, he shall be guilty'.6f <br />a Class 1 mi~demeanor, and such weapon shall be forfeited <br />to the Commonwealth and may ba seized by an officer as <br />forfeited, and such as may be needed for police'~officers, <br />conservators of the peace, and the Division of Consolidated <br />Laboratory Services shall be devoted to that purpose, and <br />the remainder shall be destroyed by the officer having <br />them in charge. <br /> <br /> This section shall not apply to any police officers, <br />sergeants, sheriffs, officers or guards of the penitentiary <br />or other institutions or camps of the State corrections <br />system~ conservators of the peace other than notaries public, <br />to carrzers oi United States mail in the rural districts, <br />while in the discharge of themr official duties, or to any <br />person while in his own place of abode. <br /> <br /> Any Circuit Court, upon a written application and <br />satisfactory proof of the good character and necessity of <br />the applicant to carry concealed weapons, may grant per- <br />mission so to do for one year. The order granting such <br />permission shall be entered in the law order book of such <br />court. <br /> <br />2 <br /> <br /> <br />
