AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, BE AMENDING SECTIONS 21-32, 21-33, 21-38, 21-39, <br />21-40, 21-42, 21-43, 21-44 AND 21-45 THEREOF, PERTAINING TO <br />CRIMES AlqD OFFENSES INVOLVING USE AND POSSESSION OF WEAPONS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That Section 21-32 be amended to read as <br />follows: <br /> <br />Section 21-32. Wilfully discharging firearms in public <br /> places. <br /> <br /> (a) If any person wilfully discharge or cause to <br />be discharqed any firearm in any street in a city or town, o~ <br />in any public place of public business or place of public <br />gathering, he shall be guilty of a class 1 misdemeanor; <br />provided, that this section shall not apply to any law en- <br />forcement officer in the performance of his official duties <br />nor to any other person whose said wilful act is otherwise <br />justifiable or excusable at law in the protection of his <br />life or property, or is otherwise justifiable or excusable <br />at law in the protection of his life or property~ or is <br />otherwise specifically authorized by law. <br /> <br /> (b) If any person wilfully discharge or cause <br />to be discharged any arrows, nails or bullets from a <br />bow or crossbow, or stones from a sling or any other sim- <br />ilar implement in any public place or places of public <br />gathering he shall be guilty of a class 1 misdemeanor. <br /> <br />2. That Section 21-33 be amended to read as follows: <br /> <br />Section 21-33. <br /> <br />Pointing or brandishing firearm or object <br />similar in appearance. <br /> <br /> (a) It shall be unlawful for any person to point, <br />or brandish any firearm, as hereinafter described, or any <br />object similar an appearance to a firearm, whether capable <br />of being fired or not, in such manner as to reasonably <br />induce fear in the mind of another. Persons violating <br />the provisions of this section shall be guilty of a class <br />1 misdemeanor. <br /> <br /> (b) Any police cfficer, in the performance of <br />his duty in making an arrest under the provisions of this <br />section shall not be civilly liable in damages for in- <br /> <br /> <br />
