AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY A~NDING AND REORDAINING SECTION 40-139 <br />THEREOF PERTAINING TO WATERFRONT W-1 DISTRICT DIMENSIONAL <br />REQUIPdEMENTS A~[D SIGN REQUIREMENTS- <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Section 40-139 of the Code of the City <br />of Portsmouth be amended and reordained to read as follows: <br /> <br />Section 40-139. Waterfront W-1 District Dimensional <br /> Requmrements and Sign Requirements. <br /> <br /> The Waterfront W-1 District has been established <br />for the purpose of promoting and preserving the potential <br />for high-intensity development and redevelopment primarily <br />for that special district located generally between the <br />Elizabeth River and Crawford Parkway on the east and west <br />and Crawford Bay and the Crawford connector on the north <br />and south. <br /> <br /> (a) within the Waterfront W-1 District as shown <br />on the Zoning Map, all of the following dimensional require- <br />ments shall be complied with: <br /> <br /> 1.1. Maximum Allowable Floor Area: The <br />total usable net floor area of all structures ten (10) or <br />more stories in height shall not exceed ten (10) times the <br />plot area. The total usable net floor area for all other <br />structures shall not exceed five (5) times the ~lot area. <br />The "total usable net floor area" shall be determined by <br />deducting from the gross floor area of a building the area <br />within or under such building devoted to the parking of <br />automotive vehicles and access thereto, and also exclusive <br />of the floor area within malls, arcades and the like passing <br />through buildings and providing general pedestrian access <br />to other properties on the same or other plots and intended <br />to meet requirements incidental to uses permitted by this <br />ordinance. <br /> <br /> 1.2. However, upon applicatmon, the City <br />Planning Co~mzssion may, at a regular monthly meeting, con- <br />sider reco~ending a special exception. The Com~issmon shall <br />take into account the relationship of such a plot to other <br />spaces and structures located in, or proposed for, this <br />Zoning District in arriving at its recommendation and ma~ <br />site comprehensive plan elements relative bhereto.
