AN OED/NANCE TO ~ THE CODE OF ~ CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 40-31 OF SAID CODE PERTAIN/NG TO DEFINITICkNS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-31 of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended and reordained to read as foll~s: <br /> <br />Section 40-31. Definitions. <br /> <br /> Unless otherwise expressly stated, the following words shall for <br />the purpose of this Chapter have the meanings herein indicated. Words <br />used in the present tense include the future. The singular number <br />includes the plural and the plural the singular. The ~x~rd "shall" is <br />mandatory, not directory. <br /> <br /> AUTOMOBILE REPAIR GARAGE. Any building or part thereof wherein is <br />kept or stored a motor vehicle or wherein painting body and fender work, <br />engine overhauling or other major repair of motor vehicles is perfoII~=d- <br />This occupancy shall not include automotive service stations as defined <br />herein. <br /> <br /> AUTO~V~T/VE SERVICE STATIONS. A place of retail business at'which <br />outdoor autonotive refueling is carried on using fixed dispensing <br />equipment connected to underground storage tanks by a closed system of <br />piping, and at which goods and services generally required in the <br />operation and maintenance of motor vehicles and the fulfilling of <br />motorist needs my also be available. The building may consist of a <br />sales office where automotive accessories and packaged automotive <br />slt0plies may be kept or displayed. It may also include one or more <br />service bays in which vehicle washing, lubrication and minor replace- <br />ment, adjustment and repair services are rendered. Such use shall not <br />include the outdoor storage of self-propelled motor vehicles, whether <br />operative or inoperative. <br /> <br /> BII.LPOARD~ Any notice or advertis~uent, pictorial or otherwise, <br />with an area of two hundred seventy-five (275) or more square feet, and <br />without regard to area, all those used as an outdoor display for the <br />purpose of mak~g anything known, the origin or place of sale of which <br />is not on the plot with such display, except that governmental notices <br />shall not be considered to be billboards. (See definition of "sign". ) <br /> <br /> BU~.DING. Any structure enclosed and isolated by exterior walls <br />constructed or used for residence, business, industry or other public or <br />private purposes, or accessory thereto, and including tents, trailers, <br />free-standing billboards and signs, fences, and similar structures <br />whether stationary or movable. <br /> <br /> <br />
