(c) Whenever the City Attorney shall have reason to believe <br />that any charitable organization, professional ~nd-raising counsel or <br />professional solicitor is c~erating in violation of the provisions of <br />this chapter or has knowingly and wilfully made any false statement in <br />any registration application or statement, report or other infommation <br />require~ by this chapter or that a charitable organization, professional <br />fund-raising counsel or professional solicitor has failed to file a <br />registration statement req~]ired by this chapter, or t¥~t there is e~ployed <br />or is about to he ~ployed in any solicitation or collection of c~ntri- <br />butions for a charitable organization any devise, scheme, or artifice to <br />defraud or to obtain money or property by means of any false pretense, <br />representation or prcx~se, or that the officers or representatives of <br />any charitable organization, professional fund-raising counsel or pro- <br />fessional solicitor have refused or failed after notice to produce any <br />records of such organization or that the funds raised by solicitation <br />activities are not devoted or will not be devoted to the charitable <br />purposes of the charitable organization in addition to all other actions <br />autllorized by law, the City Attorney ~may bring an action in the name of <br />this ~unicipality against such charitable organization and its officers, <br />such professional fund-raising counsel or professional solicitor to <br />enjoin such charitable organization or professional funud-ralsing counsel <br />or professional solicitor frc~ continu/ng such violation, solicitation <br />or collection, or engaging therein, or doing any acts in furtherance <br />thereof and for such other relief as the court dee~s appropriate. <br /> <br />Section 25-42. Exemptions. <br /> <br /> (a) q!ae following persons shall be ek~mp~ fr~m the registra- <br />tion requirements of Section 25-32 and the requirements of Section 25-35 <br />but shall otherwise be subject bo the provisions ef this chapter: <br /> <br /> (1) Educational institutions that are recognized by the <br />Superintendent of Public Instruction or that are accredited by a regional <br />accrediting association or by an organization affiliated with the <br />National Commission on Accrediting, any foundation having an established <br />identity with any of the aforementioned educational institutions, and <br />any other educational institution confining its solicitation of contri- <br />butions to its student body, alumni, faculty and trustees, end their <br />families. <br /> <br /> (2) Persons requesting contributions for the relief of <br />any individual specified ~ name at the time of the solicitation %~nen <br />all of the contributions collected without any deductions whatsoever are <br />turned over to the named beneficiary for his use. <br /> <br /> (3) Charitable organizations which do not intend to <br />solicit and receive, during a calendar year, and have not actually <br />raised or received, durLng any of the three next preceding calendar <br />years, contributions frc~ the public in excess of t~ thousand dollars <br />or which do not receive contributions frcm more than ten persons durJ_ng <br /> <br />11 <br /> <br /> <br />
