or ~he public is informed of such conviction in a manner approved in <br />writiB~g by the Manager before uny solicitation occurs; or <br /> <br /> (2) Such person has ever been en3oined by any court or <br />othezwise prohibited frcm soliciting in uny jurisdiction, unless the <br />Manager shall first determine in writing that such person is entitled to <br />solicit in such jurisdiction at the time of-soliciting within the City <br />of Portsmou~d% or that the reason for such injunction or prohibition does <br />not involve n~ral turpitude. <br /> <br /> (i) No person shall solicit within the City of Portsmouth for <br />the benefit of any other person located without the municipality, if <br />such other person refuses to supply uny infozma~on which the ~nager <br />deems necessary to assure himself that the provisions of this chapter <br />are cc~plied with. A solicitation shall be deemed te be on behalf of <br />every person who or which receives, directly or indirectly, more than <br />ton percent of the gross amount collected. <br /> <br />Section 25-40. Excessive fuDx~-raising expenses. <br /> <br /> Each charitable organization shall, as a part of its registrarion <br />statement, compute the percentage which its fund-raising expenses for <br />its preceding fiscal year bore to its support received directly frc~ the <br />public during such year. <br /> <br />Section 25-41. Enforced_nh and penalties. <br /> <br /> (a) Any person who wilfully and knovrJ_ngly violates or causes <br />to be violated any provision of this chapter, or who shall wilfully and <br />knowingly give false or incorrect infozmation to the M~nager in filJ/lg <br />statements or reports required by this chapter, whether such report or <br />statement is verified or not, shall be guilty of a misdemeanor und, upon <br />conviction thereof, shall be sentenced for the first offense to pay a <br />fine of not less than one hundred dollars and not more than five hundred <br />dollars or uDJergo Jat0risonment for not more than six months, or both, <br />and for the second and any subsequent offense to pay a fine of not less <br />than five hundred dollars and not more than one thousand dollars or to <br />undergo i~prisonment not more %hah one year, or both. <br /> <br /> (b) ~he Manager, upon his own motion or upon cc~plaint of any. <br />person, may investigate uny charitable organizatmon, professional fund- <br />raising counsel or professional solicitor to detenmine ~iaether such <br />charitable organization, professional fund-raising counsel or professional <br />solicitor has violated the provisions of this chapter or has filed any <br />application or other infozmation requested under this chapter which <br />contains false or misleading statements. <br /> <br /> <br />
