a calendar year, if all of their functions, including fund-raising <br />activities, are carried on by persons who are unpaid for their services <br />and if no part of their assets or incc~ inures to the benefit of or is <br />paid to anuy officer or msmber. Nevertheless, if the contributions <br />raised fr~u the public, whether all of such is or is not received by any <br />charitable organization during any calendar year, shall be in excess 'of <br />two thousand dollars, it shall, within thirty days after the date it <br />shall have received total contributions in excess of two thousand, <br />register with and report to the Manager as required by this chapter. <br /> <br /> (4) Organizations which solicit only within the n~mber- <br />ship of the organization by the members thereof. <br /> <br /> (5) Organizations which have no office within the <br />municipality, which solicit in the municipality frc~ without the Cc~non- <br />wealth of Virginia solely by means of belephone or telegraph, direct <br />mail or advertising in national media. <br /> <br /> (6) Organizations which have registered tH_th the Adminis- <br />trator of the Office of Consumer Affazrs of the C~monwealth of Virginia <br />or organizations which are a chapter, branch Or affiliate included in <br />the consolidated report of an organization or federated organization <br />which is so registered with said Administrator. <br /> <br /> 0~) No charitable organization shall be exen~t under this <br />section unless it shall sutxait, before any solicitation in any cat~ndar <br />year, to the Map~ger on forms to be prescribed by him, the name, address <br />and purpose of the organization ~nd a statement setting forth the reason <br />for the claim for exemption. If exempted, the Manager shall issue, <br />annually, a letter, of exemption which may be ey_hibited to the public. <br />No registration fee shall be required of any exempt organization. <br /> <br />Section 25-43. Liability inloosed by other laws not decreased. <br /> <br /> Nothing con+~Jned in this chapter shall be construed as making <br />lawful any act or omisszon which ~s now unlawful, or as decreasing the <br />liability, civil or crLminal, of any person, iu~osed by existing laws. <br /> <br />Section 25-44. Application to court for relief. <br /> <br /> Any person agrieved by any final order to the Manager, denying such <br />person any right to which he is entitled under law, may within fifteen <br />days frc~a the date of such order, apply for relief to the Circuit Court <br />for the City of Portsmouth. Either party may appeal any final order to <br />such eourt in the same manner as provided by law in cases other than <br />cases of appeals of right. <br /> <br />12 <br /> <br /> <br />
