Section 25-35. Records tO be kept by charitable organizations. <br /> <br /> Every charitable organization shall keep true fiscal records for <br />all fiscal years begir~ing on and continuing after the effectiv~ date <br />hereof, in acoordanoe with the standards set cut in Section 57-40.6, <br />Code of Virginia, 1950, as amended. Such records shall be retained for <br />a period of at least three lears after the endo of the period of which <br />they relate. <br /> <br />Section 25-36. Written contracts. <br /> <br /> (a) Every contract or agreement between professional fund- <br />raising counsel and a charitable organization must be in %~riting and <br />shall be filed with the Manager within tan days after such contract <br />or-written agre~nent is antered into. <br /> <br /> (b) Every contract, or a-written statement of the nature of <br />the arrange~ant to prevail in the absance of a contract, between a pro- <br />fessional solicitor and a charitable organization shall be filed with <br />the/~/]ager within ten days after such contract is antered into or such <br />arrangement is agreed to. <br /> <br /> (c) Ail agreements and arrangements betwean professional <br />fand-raising counsel and charitable organizations mu~.~t be reduced to <br />writing before executed or acted upon. <br /> <br />Section 25-37. Limitations on amount of payments for solicitation <br /> activities. <br /> <br /> (a) No charitable organization shall pay or agree to pay to <br />a professional solicitor or his agents, servants or e~ployees in the <br />aggregate, including reimbursement for expenses incurred, a total amount <br />in excess of fiftee~ per centl~ of the gross amount collected by it as <br />a result of his, or their, pay or agree to pay to all professional <br />solicitors retained by it and their agants, servants and employees in <br />the aggreg~ate a total amount in excess of tan per cantu~u of its support <br />received directly f~c~p~ the public in the year in ~ch such services <br />are performed. <br /> <br /> 0p) For purposes of t~his section, the payments to the professional <br />solicitor s~hall not include the purchase price to the charitable organization <br />of any tangible personal property or services wTzich are resold by the <br />organization as a part of its fund-raising activities; but the amount so <br />expended by t=he organization shall be deducted frc~ the gross amount <br />collected by it, or the organization's support received directly fr~m <br />the public, before the computation of the~percentage limitations. <br /> <br /> <br />
