I12) "Sale", "sell" and "sold". The transfer of any property or <br />the rendition of any service to any person in exchange for consideration, <br />inclu~ting any purported contribution v~ithout which such property would <br />not have been transferred or such services would not have been rendered. <br /> <br /> (13) "Solicit" and "Solicitation". The request or appeal, directly <br />or indirectly, for uny contribution on the plea or representation that <br />such contribution will be used for a charitable purpose, i~c!uding with- <br />out limitation, the following methods of requesting such contribution: <br /> <br />(a) Any oral or written request; <br /> <br /> (b) Any announcen~nt to the press, over the radio or television, <br />or by telephone or telegraph concerning un appeal or cempaign to which <br />the public is requested to make a contribution for any charitable purpose <br />connected therewith; <br /> <br /> (c) The distribution, circulation, posting or publishing of <br />any handbill, written advertisemant or other publication which directly <br />or by implication seeks to obtain public support; <br /> <br /> (d) The sale of, offer or att~npt to sell any adv=~hise~ent, <br />advertising space, subscription, ticket, or uny service or tangible item <br />in connection with which .uny appea/ is ~ade for any charitable purpose <br />or where the nan~ of any charitable organization is used or referred to <br />in any such appeal as un inducen~nt or reason for making any such sale, <br />or when or %~ere in cormection with any such sale, any statemsnt is made <br />that the whole or uny part of the proceeds frem uny~.such sale will be <br />donated to uny charitable purpose. <br /> <br /> Solicitation as defined herein, shall be deemed to occur when the <br />request is made, at the place the request ts received, w~ether or not <br />the person making the same actually receives uny contribution. <br /> <br />Section 25-32. Registration of charitable organizations. <br /> <br /> (a) Every charitable organization, except as otherwise provided <br />herein, which intends to solicit contributions within the City of Portsmouth, <br />or have funds solicited on its behalf, shall, prior to uny solicitation, <br />file an irkitial registration state~aent with the Manager upon fozms <br />acceptable to him. Each registration statement shall thereafter be <br />refiled on or before the first day of the fourth calendar month of the <br />next and each following fiscal year in which such charitable orgunization <br />is engaged in solicitation activities within the City of Portsmouth. It <br />shall be the duty of the president, chairman or principal officer of <br />such charitable organization to file the stat~zaents required herein. <br />Such state~nt shall contain the following infozmation: <br /> <br /> <br />
