AN ORDINANCE CLOSING THE FOLLOWING ALLEY: A PORTION OF <br />UNNAMED ALLEY. <br /> <br /> WHEREAS, Riley W. and Clementine McG!one have made <br />application to vacate and close and discontinue the here- <br />inafter described portion of a certain alley; and <br /> <br /> WHEREAS, by a Resolution of this Council adopted August <br />8, 1978, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia~ 1950, as a~ended, to view the hereinafter <br />described portion of said alley and to report in writing <br />whether in their opinion any, and if any, what inconvenience <br />would result from discontinuing the below described alley; <br />and <br /> <br /> WHEREAS, the said viewers have reported, in writing that <br />in their opinion no lnconvenlenc would result from the <br />closing and discontinuing of said alley. <br /> <br /> NOW, THEREFORE~ BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginias that that portion of said alley <br />hereinafter described be closed and vacated as a public alley. <br /> <br />UNNA~LED ALLEY <br /> <br /> Ail that ten (10) foot alley extending <br />from the east right-of-way line of Woodstock <br />Street to the west right-of-way line of <br />Montclair Avenue; said alley runs parallel <br />to and lies approximately 144 feet sout~~ of <br />Portsmouth Boulevard. <br /> <br /> AND BE IT FURTHER ORDAINED that the sa~e is hereby closed <br />and'vacated as a public alley, that the City of Portsmouth~ <br />Virginia, reserves unto itself perpetual easements, rights <br />and privileges to install, maintain, operate and replace <br />electric power lines within, over, under and across that <br />portion of the hereinabove described alley. <br /> <br /> This Ordinance shall be effective from the date of its <br />adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, ~irginia, <br />at a meeting held October 24, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
