1978 113 <br /> <br />AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF <br />DOUGLAS AVENUE. <br /> <br /> WHEREAS, Portsmouth Redevelopment And Housing Authority <br />has made application to vacate and close and discontinue the <br />hereinafter described portion of a certain street; and <br /> <br /> WHEREAS, by a Resolution of this Council adopted August <br />8, 1978, viewers were appointed pursuant to Section 15.1- <br />364, Code of Virginia, 1950, as ame~ded, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion any,' and~if any, what inconvenience <br />would result from discontinuing the below described street; <br />and <br /> <br /> WHEREAS, the said viewers h~ve reported inwriting that <br />in their opinion no inconvenience Would result from the closing <br />and discontinuing of said street.' <br /> <br /> NOW, THEREFORE, BE.IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that that portion of said street <br />hereinafter described be closed and vacated as a public street. <br /> <br /> DOUGIL~S AVENUE - S-78~21 <br /> <br /> Ail that certain piece or parcel of <br />land, lying and being in the City of Ports- <br />mouth,' Virginia, and comprising that portion <br />of Douglas ~venue between London Boulevard <br />and Queen Stree~ as more particularly shown <br />on a plat eKtitled: "Plat Showing Portion <br />of Douglas Avenue To Be 'Closed, Portsmouth, <br />Virginia, for Mt. Hermon Conservation & <br />Redeve!opment-Pro]ect, VA. R-69", prepared <br />byE. Stuart Ball& Associates, Ltd., Survey- <br />ing-En.gineering; Portsmouth, Virginia, dated <br />April 18, 1978, a copy'of which is attached <br />hereto. <br /> <br /> AND BE.IT FURTHER ORDAINED that the same is hereby closed <br />and vacated as a public street, that the City of Portsmouth, <br />Virginia, reserves unto itself perpetual e~sements, rights <br />and privileges, to install,, maintain, operate, and replace <br />sewer mains, sewer drains, sanitary sewers, storm drains, gas <br />mains, water mains and laterals, electric power lines and <br />telephone lines across those portions of the hereinabove <br />named street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia <br />at a meeting held October 24, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
