ORDINANCE CLOSING THE FOLLOWING <br />MONTCLAIR AVENUE. <br /> <br />STREET: <br /> <br />A PORTION OF <br /> <br /> WHEREAS~ the City of Portsmouth, Virginia has made <br />application to vacate and close and discontinue the hereinafter <br />described portion of a certain street; and <br /> <br /> WHEREAS, by a Resolution of this Council adopted August 8, <br />1978, viewers were appointed pursuant to Section 15.1-364, Code <br />of Virginia, 1950, as amended~ to view the hereinafter described <br />portion of said street and to report in writing whether in <br />their opinion any, and if any, what inconvenience would result <br />from discontinuing the below described street; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from the closing <br />and discontinuing of said street. <br /> <br /> -NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that that portion of said street <br /> -hereinafter described be closed and vacated as a public street. <br /> <br />MONTCLAIR AVENUE <br /> <br /> Beginning at the southeast corner of <br />Portsmouth Boulevard and Montclair Avenue; <br />thence south along the east right-of'way line <br />of Montclair Avenue approximately 284 feet; <br />thence west 30 feet to the west right-of-way <br />-line of Montclair Avenue; thence north along <br />said right-of-way 284 feet to the south right- <br />of-way line of Portsmouth Boulevard; thence <br />east along said right-of-way 30 feet to %he <br />point of origin. (S-78-20A) <br /> <br /> AND BE IT FURTHER ORDAINED that the same is hereby closed <br />and vacated as a public street, that the City of Portsmouth, <br />Virginia, reserves unto itself perpetual easelnents, rights <br />and privileges to install, maintain, operate, ahd replace <br />sewer mains, sewer drains, sanitary sewers, storm drains, gas <br />mains, water mains and laterals, electric power lines and <br />telephone lines within, over, under and across those portions <br />of the hereinabove named street.. <br /> <br /> This Ordinance shall be effective from the dat Of its <br />adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginiar <br />at a meeting held October 23, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
