compensation in the last four (4) years of creditable service, <br />not related to promotion which exceed the average compen- <br />sation increase in the same period received by other employees <br />holding comparable positions, or which, in case there are no <br />comparable positions, exceed the average percentage compen- <br />sation increase in the same period received bT all other em- <br />ployees, such excess shall be deducted in computing creditable <br />compensation if the board finds after consideration of all <br />circumstances that the primary purpose of such compensation <br />increase was to increase the retirement benefit of such em- <br />ployee. <br /> <br /> CREDITABLE SERVICE. The term "creditable service" shall <br /> be taken to mean for any member the most recent period of <br /> continuous service as an employee rendered by the member <br /> plus membership service for which credit is allowed under <br /> this chapter; provided however, that periods before and <br /> after periods of unpaid authorized leave shall be included <br /> as creditable service but the period of leave itself shall <br /> not be credited as creditable service. In addition, under <br /> regular service retirement and excluding deferred or vested <br /> retirement, one-third of unused sick leave as of the <br /> effective date of retirement shall be added to creditable <br /> service. In no event shall a member's creditable service <br /> include any period of service after his attainment of normal <br /> retirement age. <br /> <br /> EMPLOYEE. The word "employee" shall be taken to mean <br />any person regularly employed in the service of the city on <br />a full time permanent basis and whose compensation is wholly <br />paid by the city, and persons holding offices in the city <br />required by the Constitution of this State and their deputies, <br />assistants and employees employed on a full time permanent <br />basis and whose compensation is paid partly by ~he city and <br />partly by the state; but shall not include any person who is <br />eligible for membership in the Virginia Retirement System, <br />in the Portsmouth Fire and Police Retirement System or who <br />enters into an agreement with the city for inclusion in a <br />deferred compensation retirement plan which agreement spe- <br />cifically prohibits inclusion in other retirement systems <br />established by the city. In case of doubt the board shall <br />decide who is an employee within the meaning of this article. <br /> <br /> EMPLOYER. The word "employer" shall be taken to mean <br />the city or the authority of the city having the power to <br />appoint an employee to office or employment. <br /> <br />2 <br /> <br /> <br />
