AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 35-224.1 THEREOF, PERTAINING TO PERSONS PERMITTED TO TRANSFER ELIGIBILITY. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained by amending Section 35-224.1 thereof to read as follows: Section 35-224.1. Transfer of eligibility. (a) Not withstanding the provisions of subsection (c) of Section 35-224: (1) A taxpayer who is otherwise eligible for a tax exemption under this Article shall not be deprived of such exemption if compelled by eminent domain proceedings, the threat of such proceedings or act of God to abandoned the residence to which such tax exemption appertains. The tax exemption applicable to the residence which the taxpayer is forced to abandoned shall be transferable to any residence purchased within twelve (12) months after title to the first residence is conveyed or condemned. (2) A taxpayer who is otherwise eligible for a tax exemption under this Article shall not lose such eligi- bility and may transfer same if he/she changes residences within the City of Portsmouth. (b) Any taxpayer seeking a transfer of an exemption shall make application therefor on forms provided by the director. Such forms shall include an affidavit reciting the facts which demonstrate eligibility for such exemption. If the director finds that the applicant is eligible for such exemption, he shall so certify to the city treasurer. The. city treasurer shall thereupon deduct the exempted amount from the applicant's real estate tax liability. The exemption transfer~ if granted, shall take ~ffect from the date of the filing of the transfer application. 2. This ordinance shall be effective from the date of its adoption.
