AN ORDINANCE ~O AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 19~3, BY AMENDING SECTION 40-210(d) THEREOF, PER- <br />TAINtNG TO JURISDICTION, POWERS AND DUTIES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-210(d) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 40-210. <br /> <br />Jurisdiction, powers and duties. <br /> <br /> (d) (1) Upon application of churches and places <br />of worship situate in areas zoned R-60 and R-60(a), the <br />Board of Zoning Appeals may grant a variance from the off- <br />street parking requirements of Section 40-45 herein, pro- <br />vided it is established that the church or place of worship <br />was in existence on the effective date of the Zoning Ordinance, <br />April 25, 1961; that the abutting area is densely built to an <br />extent of no less than Five Thousand (5000) persons per gross <br />square mile. <br /> <br /> (2) The Board of Zoning Appeals shall have no <br />authority to alter the requirements of this Chapter with <br />respect to off-street loading spaces and Off-street parking, <br />except as provided in subparagraph (d) (1) of this section. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held June 27, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
