AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH~ VIRGINIA, 1973, AS AMENDED, BY AMENDING SECTION 14-9, THEREOF, PERTAINING TO LITTER RECEPTACLES. BE IT ORDAINED by the Council of the City of Portsmouth that Section 14-9 of the Code of the City of Portsmouth, 1973, as amended, be amended to read as follows: Section 14-9. Litter Receptacles. (a) As used in this section, a litter receptacle shall mean a container with a capacity of not less than ten (10) gallons, constructed and placed for use as a depository for litter; except that large containers known as "dumps%ers" and garbage containers for single or multi-family residences may be used as receptacles for deposit of litter, but these con- tainers are not included within this definition and their use is in no way governed by this section. (b) Litter receptacles shall be required in the follow- ing public places. The minimum number of litter receptacles for each public place shall be specified herein. Additional receptacles may be required by the Building Official or his representative as de%ermined by the needs of a particular location. (t) SIDEWALKS IN BUSINESS DISTRICTS: The need for receptacles and their placement, and the responsibility for their maintenance and service~ shall be CONTROLLED by the Building Official or his representative. (22 SHOPPING CENTERS: Receptacles shall be located along pedestrian travel routes normally taken by persons using said facil±ty. The number and placement of receptacles shall be determined by the operator, or group responsible for the operation of said facility; except no less than one receptacle shall be placed at each entrance %o the building or buildings. All parking lots and establishments with parking lots shall provide litter receptacles distributed within the parking area. (3) DRIVE-IN RESTAU_RANTS AND FAST-FOOD RESTAURANTS: One receptacle per establisb/uent, plus additional receptacles as necessary to contain litter generated by the facility. (4) SELF-SERVICE REFRESHMENT AREAS: One receptacle for each separate area, provided each separate area contains two or more ~achines for dispensing, or serving food and/or.drink. (5) GASOLINE SE~ZICE~STATIONS: One receptacle per service island.
