AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH~ <br />VIRGINIA, 1973, AS AMENDED, BY AMENDING SECTION 14-9, <br />THEREOF, PERTAINING TO LITTER RECEPTACLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth <br />that Section 14-9 of the Code of the City of Portsmouth, 1973, <br />as amended, be amended to read as follows: <br /> <br />Section 14-9. Litter Receptacles. <br /> <br /> (a) As used in this section, a litter receptacle shall <br />mean a container with a capacity of not less than ten (10) <br />gallons, constructed and placed for use as a depository for <br />litter; except that large containers known as "dumps%ers" and <br />garbage containers for single or multi-family residences may <br />be used as receptacles for deposit of litter, but these con- <br />tainers are not included within this definition and their use <br />is in no way governed by this section. <br /> <br /> (b) Litter receptacles shall be required in the follow- <br />ing public places. The minimum number of litter receptacles <br />for each public place shall be specified herein. Additional <br />receptacles may be required by the Building Official or his <br />representative as de%ermined by the needs of a particular <br />location. <br /> <br /> (t) SIDEWALKS IN BUSINESS DISTRICTS: The need for <br />receptacles and their placement, and the responsibility for <br />their maintenance and service~ shall be CONTROLLED by the <br />Building Official or his representative. <br /> <br /> (22 SHOPPING CENTERS: Receptacles shall be <br />located along pedestrian travel routes normally taken by <br />persons using said facil±ty. The number and placement of <br />receptacles shall be determined by the operator, or group <br />responsible for the operation of said facility; except no <br />less than one receptacle shall be placed at each entrance %o <br />the building or buildings. All parking lots and establishments <br />with parking lots shall provide litter receptacles distributed <br />within the parking area. <br /> <br /> (3) DRIVE-IN RESTAU_RANTS AND FAST-FOOD RESTAURANTS: <br />One receptacle per establisb/uent, plus additional receptacles <br />as necessary to contain litter generated by the facility. <br /> <br /> (4) SELF-SERVICE REFRESHMENT AREAS: One receptacle <br />for each separate area, provided each separate area contains two <br />or more ~achines for dispensing, or serving food and/or.drink. <br /> <br /> (5) GASOLINE SE~ZICE~STATIONS: One receptacle per <br />service island. <br /> <br /> <br />
