Section 40-124. Procedure for Certificate of Compatibility as required unde~ Sec~ 40~120~ Before th~ bul .d~ng official may issue a bu~ld±ng permit for the construction oz alteration of a building, for the uses pres'crtbed in Sec. 40-120[b), plans therefor shall be approved and a certificate of compatlblllt~ issued by the City Planning Commission. Prior to any such action by the City Planning Commission, mn applicant shall submit plans and design documents to the Planning Director who shall an least two (2) calendar weeks prior to the date of a Co~nisslon meeting, conduct an open meeting. Notice of th~s opportunity to comment shall be published by the Planning Director at least one (1) week prior to said meeting and shall specify the time, date and address of the meeting. The Planning Director or his designee at the time and place specified', shall provide all persons present, an opnortunit~ to inspect plans and design documents and to ask questions. Tke Planning Con~aission, in addressing any such application, shall do the following four (4) things: (~1) }Iear from the applicant on his plans for construction or alteration; [21 Receive from the Planning Director a report of the meeting conducted; (31 Hear from any party expressing an interest in the matter; and [4) Receive from the Building Official a report contain- ing any recommendations his office may care to offer. If the Planning Commission shall find that the applications sought will not: (i1) Adversely affect the health or safety of the persons residing or working in the neighborhood of the pro- posed use; ~) Will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood; and (3) Will be ~in accord with the purposes of the Zoning Ordinance of the City of Portsmouth, it shall approve and issue the cer- tificate of compatibility to the applicant. The Commission may deny the application, specifying its reasons. An application on the same property may be submitted for consideration by the Commission after sixty (60) days of the ~revious action of the Commission.
