Section 40-125. Certificate of complaince for rental dwellings <br /> required. <br /> <br /> Because of the uniqueness of the structures in the Down- <br />town D-1 Zoning District and, mn an effort to safeguard the <br />health, safety and welfare of the citizens of the City of <br />Portsmouth, and especially the occupants of rental dwelling <br />units in structures where the ground floor is used in a manner <br />other than for residential use, in addition to the provisions <br />of Section 17-35 of this Code, a reinspection of such structure <br />shall be made annually. A certificate of compliance for <br />rental dwellings shall be obtained each year in the Months of <br />October and November, and such certificate shall remain valid for <br />one {1) year from the date issue. <br /> <br />Section 40-126. Vacant lots/plots. <br /> <br /> The o%~ner or his agent Of vacant lot or plot shall be <br />required to maintain such lot or plot free of weeds, debris <br />or any other health hazard and public nuisance as required, <br />regulated and governed by Article 39 of the City Code. In <br />this district, such lot or plot shall be maintained covered <br />with grass not higher than six (6) inches or in the condition <br />specified in accordance with the landscape plan approved by <br />the building official. The owner or his agent may submit <br />a landscape plan for the lot or plot to the building official <br />for his approval. Such plan if approved shall supercede the <br />six inches high grass requirement. Such landscape plan must <br />be submitted within thirty (30) days of enactment of this <br />district. Penalty for noncompliance with this section shall <br />not be less than one thousand ($1rO00.) dollars or more than <br />three thousand ($3,000.) dollars for each notice of violation. <br />Such notice shall be in writing and shall be delivered or <br />mailed to the last known address of the owner and the proof <br />of such mailing shall be sufficient evidence of serving such <br />notice by mail. <br /> <br />Section 40-127. Violation corrections required. <br /> <br /> The building official shall provide the owner os his legally <br />designated agent a written notice s~atinq therein the reasons <br />for,~enial of certificate of %~~as required by section <br />40-~2~. The owner shall initiate to correct tne cited violations <br />within thirty (30) days of receiving such notice. The owner, <br />in addition, to the initiation of corrections of the cited <br />violations, shall in writing inform the building official of <br />the date by which the violations shall be corrected, such <br />date shall not exceed one hundred and twenty (120) days. Under <br />special circlnr~stances, such as weather or nona~ailability of <br />material, labor and such, the building official may grant an <br />extension %o the date when such corrections must be completed. <br /> <br /> <br />
