AN ORDINANCE CLOSING THE FOLLOWING STREET: A 50' ALLEYWAY ON THE WEST SIDE OF ALLARD ROAD. WHEREAS, Russell B. Harper and Magdalene Harper and William Barnes have made application to vacate, close and discontinue the hereinafter-described portion of a certain street; and WHEREAS~ by a resolution of this Council adopted June 26~ 1979, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter-described portion of said street and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing the hereinafterrdescribed street; and WHEREAS~ said viewers have reported in writing that in their opinion, no inconvenience would result from the closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginma, that a portion of said street herein- after-described be closed and vacated as a public street. Beginning on the west side of Allard Road approximately 799' westerly; and thence southerly from the northwest intersection of Allard Road and Gust Lane; thence, west 90'; thence south 50'; thence east 90' to the west right of way of Allard Road; thence north along the said right-of-way 50' to the Point of Beginning. BE IT FURTHER ORDAINED that the same is hereby closed and vacated as a public street, that the City of Portsmouth, Virginia, reserves unto itself perpetual easements, rights and privileges to instali~ maintain~ operate and replace sewer mains~ sewer drains, sanitary sewers, storm drains, gas mains, water mains and laterals, electric power lines and telephone lines and boxes within, over, under and across the portions of the hereinabove- named street.
