AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-56(2) THEREOF, PERTAINING TO RESIDENTIAL PARKING DISTRICTS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-56(2) of the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: (2) ~enever the City ~anager or his designees shall determine that the streets of a particular district or dis- crete oortion of a district mn which residential uses are permit%ed and commercial and industrial uses are not Dermitted are being used for parking by the ooerators of vehicles while the operators of those vehicles are using districts or portions of districts in which commercial or industrial uses are-permitted and-the average number of vehicles parking in such a manner is in excess of twenty-five (25) per cent ~of the number of parking spaces on such streets and the total number of spaces actually occupied by any vehicle exceeds seventy-five (75) per cent of the number of spaces on such streets on the weekdays of any month, as determined by a survey, the City Manager or his designee may by rule, regulation or order provide for the restriction of parking during the hours when such use has been found on those streets of those districts or portions of dis- tricts found by the survey to have been so affected. In such cases, the City Manager shall cause appropriate signs giving notice of the restricted parking to be posted on those streets restricting such parking under the conditions established by such order, rule or regulation which shall be applicable to all parking except parking by the holders of permits to be granted only under the following conditions: (a) To the owner or the operator of a motor vehicle who resides, owns real property or has a leasehold interest in real property within the area where parking is so restricted and to be limited to one ('1[ permit for each vehicle owned or used by that person and described in the application or amend- ment to it submitted by that person. (b) To persons whc are visitors of any residence of any particular area in which parking ms so restricted, to be limited to that particular area in which parking is so restricted, to be valid for a stated period but no more than thirty (30) days.
