(~ NO other matters shall be sufficient grounds for <br />denial of an application for such permit. <br /> <br />Section 3-36. <br /> <br />Suspension, revocation of permit; notice and <br />hearing. <br /> <br /> (a) The City Manager may revoke or suspend the permit <br />for the operation of a commercial recreation center if he <br />finds: <br /> <br /> - (1) _~Tha~the preini~s have been declared a common <br />nuisance by a court of competent jurisdiction. <br /> <br /> (2) That circumstances exist which would have <br />justified a denial of said permit at th~ time of its issuance. <br /> <br /> (3) That the permittee has consistently failed in <br />some material respect to operate the center on an orderly basis <br />in accordance with the provisions of this Article or the approved <br />house rules. <br /> <br /> (4) <br />and vigorous <br />occurring on <br /> <br /> That the permittee has failed to take prompt <br />action against violations of cr~inal statutes <br />his premises and known to the permittee. <br /> <br /> (b) A permittee shall be entitled to a hearing before <br />the City Manager before such permit is revoked. The. City Manager <br />shall give the permittee ten (10) days notice of his intention <br />to revoke said permit. Notice shall be served by certified <br />mail, return receipt requested. The City Manager shall, as <br />part of such notice, provide the permittee witI~a written <br />statement of the grounds for revocation or suspension and <br />advise him of his right to a hearing. The hearing shall be <br />held not less than ten (10) days, nor more than twenty (20) days <br />after the giving of notice, but the permittee may waive the <br />ten (10) day limitation. The permittee shall have the right <br />to be represented by Council at such hearin~ and may present <br />evidence in his own behalf. <br /> <br />Section 3-37. Permit nontransferrable. <br /> <br /> No permit issued under this Article shall be assignable <br />to any third person or corporation. When the permittee shall <br />cease to operat~ the'center for a period of thirty (30) da~s, <br />the permit shalll be void. <br /> <br />Section 3-38. <br /> <br />Minors prohibited from center during certain <br />hours; posting of signs° <br /> <br /> No permittee, its officers, agents or e~loyees, shall <br />allow any person under the age of eighteen (18) years to remain <br />in the. center between the hours of 12:O0 Midnight and 7:OO A.
