Section 3-34. Action by City Manager on permit application; application fee. Upon receipt of an application for a permit, the City Manager shaLL immediately cause an investigation to be made concerning the qualifications of the applicant and whether the proposed center is in compliance with this Article. The City Manager shall grant or deny such permit and shall notify the applicant in writing of his action wi%bin twenty (20) days of the filing of the application. If the City Manager denies such permit, he shall state in writing his reasons for such actibnJ E~'er~pp~i~&~i'on'~hali' be ~Cc0~anied by a fee of fifty ($50°00)' dollars, which shall no~ be refundable. Section 3-35.~-G~ounds for denial ~f permit. The following factors shall constitute'~groun~s for denial of a~permit for .operation of a center:. (a} A finding by the City Manager that the applicant has falsified his application in a material manner. (b) A finding by the City Manager that ~he applicant o~ any of his designated managerial employees has a criminal record which reveat~ any convictions for violation of ~ny dl~ug or alcoholic beverage control ~aws, gambling laws, sex offenses, selling or distribution of pornographic material, or any pattern of criminal misconduct as evidenced by a series of convictions. (c) A finding by the City Manager that the proposed use of the property shall not comply with all provisions of law or that same will adversely'affect the health or safety of persons residing or working in the neighborhood or,the pro- posed use or will be detrimental to the public welfare or that there is an undue concentration of such complexes in the area requested. (d) A finding by the City Manager that there is insufficient space for the number of machines requested. (e) A finding by the City Manager that %he applicant consistently and habitually fails to cooperate with law en- forcement personnel in the exercise of their official duties. (f) A finding by the City Manager that the application is not properly completed as required by this Article. (g) A fin~ing by the City Manager that the proposed center fails to comply with.the provisions or,this Article.
