AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1950, AS AMENDED, BY AMENDING SECTIONS 39-1, 39-9, <br />39-10, 39-11 and 39-13, PERTAINING TO INOPERATIVE MOTOR <br />VEHICLES, AND BY ADDING TO CHAPTER 23 THEREOF, SECTION 23- <br />470..1 PF~RTAINING TO LICENSE TAX FOR MOTOR VEHICLES NOT <br />DISPLAYING CURRENT LICENSE PLATES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. Shat Sections 39-1, 39-9, 39-10, 39211 and 39-13 <br />of the Code of the City of PortSmouth, Virginia, 1973, be <br />amended and reordained to read as follows, and that Section <br />23-470,1 be added to Chapter 23 to read as follows: <br /> <br />Section 39-1. Definitions. <br /> <br /> The following words and phrases, when used in this <br />Article, shall, for the purposes of this Article, have the <br />meanings respectivety~ascribed to them in this section, <br />except in those instances where the context clearly in- <br />dicates a different ra~aning: <br /> <br /> ALLEY. A public way~ other than a street, designed for <br />vehicular or pedestrian travel to provide access toot from <br />the rear or side of property. <br /> <br /> DEBRIS. Dead or dying standing weeds,~ trash, junk, <br />discarded or abandoned parts of vehicles or any other <br />material or substance which may provide a hover for snakes <br />or rats or anything os any condition which may be a fire <br />menace or breeding place for mosquitos, give off obnoxious <br />or offensive odors, or endanger the health or safety of <br />the residents of this City. <br /> <br /> DIRECTOR. The Director of Public Health and his re- <br />presentatives, when duly authorized by him to administer and <br />enforce the provisions of this Article. <br /> <br /> INOPERATIVE MOTOR VEHICLE. Any motor vehicle, as defined <br />in ~46.1-I, Code of Virginia, 1950, which is not in operating <br />condition; or which for a period of ninety (90) days or longer <br />has been partially or totally disassembled by the removal of <br />tires and wheels, the engine, or other essential parts required <br />for operation of the vehicle; and for which there is no valid <br />license plate and inspection sticker. <br /> <br /> OCCUPANT. A tenant or any person who is in control or <br />possession of or actually occupies land in the City. <br /> <br /> <br />
