AN ORDINANCE TO AF~END THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973r BY AMENDING CHAPTER 38 THEREOF BY ADDING <br />SECTION 38-83, PERTAINING TO DAMAGES TO WASTE WATER FACILITIES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />Code of <br />follows: <br /> <br /> That Section 38-83 be <br />the City of Portsmouth, <br /> <br />added to Chapter 38 of the <br />1973, as amended, to road as <br /> <br />Section 38-83. Additional fees and charges; fees for the <br /> removal of obstructions. <br /> <br /> If the drainage or discharge from any establishment or <br />premises causes a deposit, obstruction, or dam~geto any of <br />the City's waste water facilities, which includes but is not <br />limited to manholes, and water and sewage lines, and the <br />surfaces including streets and rights-of-way above, below <br />and around said facilities, the Director of Public Utilities <br />shall cause the deposit or obstruction to be promptly removed <br />or cause the damage to be promptly repaired. The cost for <br />such work, including materials, labor, overhead and supervision, <br />whether such work is performed by the City of Portsmouth or <br />by an outside contractor, shall be borne by such person <br />causing or contributing to such deposit, obstruction, or <br />damage, or to the owner of.the premises which causes such <br />deposit, obstruction, or damage. Payment of such actual <br />cost does not relieve that person from criminal prosecution <br />or other liability thaf may be imposed by other applicable <br />law. <br /> <br /> 2. This ordinance shall take effect from the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held July 13, 1982. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
