If the assessment be less than the proper amount, the <br />Commissioner of %he Re~nue or the City Assessor shall assess <br />such applicant with tb~ prope~ amount. <br /> <br /> When an unpaid erroneous assessment of real estate is <br />corrected under this Section, and such real estate has been <br />sold at ~ delinquent land sale, the City Assessor shall certify <br />a copy of-such correction to the Clerk of the Circuit Court <br />of the City of Portsmouth and said Clerk shall note such <br />correction in the Delinquent Land Book opposite the entry of <br />the tract or lot for the ~ear or years for which such correction <br />-is made. <br /> <br /> Where the assessment which is subsequently considered <br />erroneous was made as a result of miscalculation or ministerial <br />error on the part ~f the Commissioner of the Revenue or the <br />City Assessor, interest on the amount erroneously assessed <br />will be paid along with the refund at a rate of ten percent <br />(10%) per annum from the date that the-tax was paid or from <br />the date said tax was required to be paid, whichever date is <br />later. No interest will be paid where the assessment in <br />question was based on a good faith assessment or was made as <br />the result of ~ statutory assessment. <br /> <br /> 3.
