AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AM-ENDING SECTIONS 40-31, 40-68 (b), 40-68.1 <br />(e), 40-70 (b), 40-71 (b), 40-73 (b), 40-74 (b), 40-75 (b), <br />40-76 ~b), 40-77 (b), 40-78 (b), 40-79 (b), 40-121 fa), PER- <br />TAINING TO ADULT AND CHILD CARE FACILITIES. <br /> <br /> BE IT ORDAINED by the Council Of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-31 of the Code of th~ City of Ports- <br />mouth, Virginia, 1973, be amended by adding thereto the follow- <br />ing definitions to read as follows: <br /> <br />Section 40-31. Definitions. <br /> <br /> CHILD CARE CENTER: Any facility, except a public or <br />private school providing care to a group of ten (10) or more <br />children separated from their parents or guardians during a <br />part of the day on a regular basis, including, but not limited <br />to, centers which qualify for approval by the Department of <br />Welfare. <br /> <br /> FAMILY CARE HOME: Any facilityf except a public or <br />private school providing care to a group of six (6) but less <br />than ten (10) children separated from their parents or guardians <br />during a part of the day on a regular basis, including, but not <br />limited to, homes which quaIify for approval by the Department <br />of Welfare. <br /> <br /> GROUP HOME FOR CHILDREN: Any facility to provide group <br />living accommodations and/or operated for maintenance and care <br />of four (4) or more children under the age of eighteen (18) years <br />who are not able to reside in their own homes, including, but <br />not limited to, facilities qualified to ~e licensed bythe <br />Department of Watfare or Mental Health and Mental Retardation. <br /> <br /> GROUP HOME FOR ADULTS. An~ facility to provide group <br />living accommodations and/or operated for the maintenance and <br />care of four (4) or more adults who are affected by age, mental <br />health, and/or physical disabilities, including, but not limited <br />to, facilities qualified to be licensed by the Department of <br />Welfare or Mental Health or Mental Retardation. <br /> <br /> 2. That Section 40-31 of the Code of the City of Portsmouth, <br />Virginia, 1973, be further amended by removing the following <br />definitions: <br /> <br />(!) Group residence; <br />(2) Group home. <br /> <br /> <br />
