4. That Section 23-309(b) of the Code of the City <br />of Portsmouth, Virginia, 1973, be amended and reordained to <br />read as follows: <br /> <br />Section 309. <br /> <br />Driver to make report of certain accidents <br />to police; supplemental reports; reports by <br />witnesses. <br /> <br /> (b) The Chief Of Police may require any driver of a <br />vehicle involved in any accident of which report must be <br />made to file a supplemental report whenever any report is <br />insufficient in his opinion and he may require witnesses <br />of accidents to render reports to the police department. <br />A wilful fail~re to file the report required in this section <br />Shall constitute a Class 4 Misdemeanor. <br /> <br /> 5. That Section 23-311 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to <br />read as follows: <br /> <br />Section 23-31t. Occupants to report when driver incapable. <br /> <br /> Whenever the driver of a vehicle is physically incapable of <br />making an immediate or a written report of an accident of <br />which a report is required, each other occupant of the vehicle <br />at the time of the accidentw if any, who is capable of so <br />doing must make the report required by this article to be <br />made primarily by the driver, but this will not include a <br />certification of insurance. A wilful failure to file the <br />report required by this section shall constitute a Class 4 <br />Misdemeanor. <br /> <br /> 6. That Section 23-392(e) of the Code of the City of' <br />Portsmouth, Virginia, 1973, be ~uended and reordained to <br />read as follows: <br /> <br />Section 23-392. ~en safety glass required. <br /> <br /> (et If any person shall operate any vehicle in violation <br />of the provisions of this section, he shall be guilty of a <br />Class 4 Misdemeanor; if such person shall operate such vehicle <br />under a certificate issued by the State Corporation Commission, <br />the certificate of such person may also~ in the discretion <br />of the State Corporation Commission, be suspended until the <br />provisions of this section are satisfactorily complied with. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held January 11, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
