AN ORDINANCE CLOSING A PORTION OF FAYETTE STREET. <br /> <br /> W~EREAS~ Portsmouth Redevelopment & Housing Authority' has <br />made application to vacate and close the herefnafter described <br />portion of Fayette Street; and <br /> <br /> W~EREAS, by resolution of this Council adopted October 11, <br />1983, viewers were appointed pursuant to Section 15.1-364, Code of <br />Virginia, 1950, as amended, to view the hereinafter described <br />portion of Fayette Street and to report in writing whether in <br />their opinion any, and if any what, inconvenience would result <br />from this continuing said street; and <br /> <br /> WtIEREAS, the said viewers have reported in writing that in <br />their opinion no inconvenience would result from the closing and <br />discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of %he City <br />of Portsmouth, Virginia, that the hereinafter described portion <br />of Fayette Street be closed and vacated as a public street. <br /> <br />Fayet~e St'r'eet <br /> <br /> All that certain piece or parcel of land lying <br />and being in the City of Portsmouth, Virginia, as <br />shown on the plat entitled "Plat Showing Closure of <br />a Portion of Fayette Street, Portsmouth, Virginia, <br />for Portsmouth Redevelopment & Housing Authority, <br />Effingham Street VA~R-72'', dated June 10, 1983, <br />revised July 19, 1983r prepared by Hasselt & Folkes, <br />P.C., surveyors and engineers, Portsmouth, Virginia, <br />co~prising that portion of Fayette Street which is <br />bounded on the west by the eastern right-of-way line <br />of Green Street and extending in an easterly direction <br />281.93' to a point being on the wes%em right-of-way <br />line of the former Eighth Street (now being property of <br />Portsmouth Redevelopment & Housing Authority) (S-83-12). <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmoutk reserves <br />unto itself the perpetual easements, rights and privileges to <br />install, operate and maintain gas mains, and telephone lines <br />under, over and across the hereinabove described property. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held November 22, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
