from the building official, provisions of this article to <br />the contrary notwithstanding, nor to prevent any repair, <br />maintenance, painting, or alteration of any such feature <br />which the building inspector shall certify to be required by <br />the public safety because-'of any unsafe or dangerous con- <br />dition. <br /> <br /> (d) The committee shall not consider detailed <br />designs, interior arrangements or features of a building or <br />structure which are not subject to public view from a public <br />street, public way or other public place, and shall not <br />make any requirements except for the purpose ~ preventing <br />developments incongruous to the historic aspects of the <br />surroundings and the Downtown District. <br /> <br /> (e) Upon receipt of an application for a cert- <br />ificate of compliance and the plans and specifications, <br />the committee shall confer with the applicant for the <br />certificate of complaince and shall advise, approve or <br />disapprove such plans and specifications, and if approved <br />shal~ issue a certif±cate of compliance therefor with or <br />without conditions, or with such modifications of the plans <br />and specifications as the committee deems necessary to <br />execute the purposes and objectives of the plan and the design <br />guidelines and to require compliance with the regulations <br />and restrictions set out in the certificate of intent; other- <br />wise the committee shall reject such plans and specifications <br />and shall not issue the certificate of compliance. The failure <br />of the commission to approve or disapprove such plans and <br />~pecifications with or without conditions or modifications, <br />w~thin sixty (60) days from the date of application for the <br />certificate of compliance shall be deemed to constitute <br />approval of the plans and specifications as submitted, and <br />the b~ilding official shall issue any required permit provided <br />the work to be done under the permit complies with the re- <br />quirements of the building code and other ordinances and <br />laws applicable or relating thereto. <br /> <br />Section 40-124. Vacant Ices/plots. <br /> <br /> The owner of any vacant lot within the district shall <br />be required to maintain such lot free of weeds, debris, or <br />other health hazard or public nuisance as required and govern- <br />ed by Chapter 39 of the Code of the City of Portsmouth. In <br />the event any lot or plot within the district is found to be <br />in violation of this section, notice shall be given to the <br />owner of such lot, or his duly authorized agent, as provided <br />in Chapter 39 of the Code of the City of Portsmouth.
