from the building official, provisions of this article to the contrary notwithstanding, nor to prevent any repair, maintenance, painting, or alteration of any such feature which the building inspector shall certify to be required by the public safety because-'of any unsafe or dangerous con- dition. (d) The committee shall not consider detailed designs, interior arrangements or features of a building or structure which are not subject to public view from a public street, public way or other public place, and shall not make any requirements except for the purpose ~ preventing developments incongruous to the historic aspects of the surroundings and the Downtown District. (e) Upon receipt of an application for a cert- ificate of compliance and the plans and specifications, the committee shall confer with the applicant for the certificate of complaince and shall advise, approve or disapprove such plans and specifications, and if approved shal~ issue a certif±cate of compliance therefor with or without conditions, or with such modifications of the plans and specifications as the committee deems necessary to execute the purposes and objectives of the plan and the design guidelines and to require compliance with the regulations and restrictions set out in the certificate of intent; other- wise the committee shall reject such plans and specifications and shall not issue the certificate of compliance. The failure of the commission to approve or disapprove such plans and ~pecifications with or without conditions or modifications, w~thin sixty (60) days from the date of application for the certificate of compliance shall be deemed to constitute approval of the plans and specifications as submitted, and the b~ilding official shall issue any required permit provided the work to be done under the permit complies with the re- quirements of the building code and other ordinances and laws applicable or relating thereto. Section 40-124. Vacant Ices/plots. The owner of any vacant lot within the district shall be required to maintain such lot free of weeds, debris, or other health hazard or public nuisance as required and govern- ed by Chapter 39 of the Code of the City of Portsmouth. In the event any lot or plot within the district is found to be in violation of this section, notice shall be given to the owner of such lot, or his duly authorized agent, as provided in Chapter 39 of the Code of the City of Portsmouth.
