which shall contain specifications for use, building, height, <br />bulk, location (with setback requirements), required n~mber <br />of parking spaces, landscaping requirements, signs, and other <br />design features to be incorporated. <br /> <br /> (b) The committee shall confer with the ~plicant on <br />the proposal, discuss th% design parameters, and issue "certif- <br />icate of intent" specifying the design items and the general <br />location of such exterior features as will be visible from <br />the public street, way, or place. <br /> <br />Section 40-123. Certificat of Compliance. ~ <br /> <br /> Ca) Before any modification, alterationsr r~- <br />construction, construction, repair, maintenance activity, <br />including painting of an outer wall or part of a building <br />or structure which are subje.~ct to public view from a public <br />street, public way or other public place, occurs in the <br />Downtown D-t District, the plans therefor, shall be reviewed <br />by the design committee. Whenever any person shall apply <br />for a building permit in such area, the building official <br />shall forthwith transmit a copy of the plans to the committee <br />for review. <br /> <br /> (b) Application for a certificate of compliance <br />to externally repair, maintain, paint, locate, construct, <br />reconstruct, alter, or demolish a building, structure, or <br />any other improvement in the Downtown D-1 ~istrict shall <br />be made to the Downtown Design Co~mmittee in %~ri~ing by the <br />owner or the legal agent of such building, structure or <br />property. The application shall be accompanied by plans. <br />a~d specifications of the improvements, building or structure <br />which are or will be subject to public view fr0m~'a public <br />street, public way, or public place. Such plan shall show <br />general design, arrangement, texture, materials, planting <br />and color proposed to be used in external repair, maintenance, <br />painting, location, construction, reconstruction or alteration <br />of the building, structure or improvements and the type <br />windows, exterior doors, lights and lighting fixtures, signs, <br />parking lot and treatment, landscaping and other fixtures <br />and appurtenances which will be subject to public view from <br />a public way, street or place. <br /> <br /> (c) Nothing in this chapter shall be construed to <br />prevent the owner of such building~ structure or property in <br />the Downtown D-1 District from performing any maintenance <br />alteration or painting to the external architectural features <br />of such building, structure or propert~ which does no~ involve <br />a change in design, material, color or the outward appearance <br />thereof and which maintenance, painting or alteration is of <br />such nature that it may be lawfully affected without a permit <br /> <br />5 <br /> <br /> <br />
