AN ORDINANCE TO AM_END THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY ADDING TO CHAPTER 40 THEREOF, ARTICLE <br />XIII, PERTAINING TO THE REGULATION OF SIGNS; BY AMENDING <br />SECTION 40-210(b) PERTAINING TO VARIANCES~ BY AMENDING SECTION <br />40-31, 40-68.1, PERTAINING TO SIGNS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Article XIII be added to Chapter 40 of the Code <br />of the City of Portsmouth, Virginia to read as follows: <br /> <br />Section 40-281. Purpose: <br /> <br />The purpose of this Article is to: <br /> <br /> (I) Permit and regulate signs in such a way to promote <br />clarity in transmission of sign information, prevent over- <br />crowding of space, duplication in infoz--mation, obstruction <br />of vision necessary for smooth flow of traffic; <br /> <br /> (2) Regulate such signs as will not, by their reason, <br />size, location, construction or manner of display, endanger <br />the public safety of individuals, confuse or obstruct the <br />flow of traffic bv undue diversion of driver's attention or <br />otherwise endange~ public safety; and <br /> <br /> (3) Support and complement the goals and objectives <br />of the Comprehensive Plan and the Zoning Ordinance to promote <br />public health, safety, morals and welfare. <br /> <br />Section 40-282. Definitions. <br /> <br /> As used in %his Article, the following words and phrases <br />shall have the meaning set opposite them for any and all <br />purposes: <br /> <br /> Above Ground Sign shall mean any sign ~hich is supported <br />by structures or supports in or upon the ground, which is <br />more than eight (8) feet in height measured from the level <br />of the public street on which it faces to the bottom edge of <br />the sign, and which ±s independent of support from any <br />building or other structure. This definition shall <br />include off-premises signs as defined herein. <br /> <br /> Advertising Display Area shall mean the advertising <br />display surface area encompassed by one continuous line, <br />connecting the extreme ~oints or edges of a sign. The <br />structural supports for a sign, wh~ther they be columns, <br />pylons, or a building or part %her~of, shall not be included <br />in the advertisement area unless they are designed as an <br />integral Dart of the display for the purpose of illustration <br />or attraction. <br /> <br /> <br />
