ARTICLE VI. Condominiums Section 33-80. Submission of plats. Condominiums and conversion condominiums as defined here- in, shall be required to submit to the Planning Commission condominium or conversion condominium plats prepared in accord- ance with §55-79.58 of the Code of Virginia and a copy of all documents filed with the'Virginia Real Estate Commission. Said plat and documents shall be subject to approval as required by this Chapter for subdivision plats. Section 33-81. Conformity to zoning and land use. No condominium or conversion condominium shall be approved by the Planning Commission which does not conform to the zoning, land use, and site plan requirements and regulations of the Code of the City of Portsmouth for the property on which such structure is located until such time as the declarant of the condominium shall secure such use permit or variance as may be applicable under the Portsmouth City Code for similar property under a ~ ~ different form of ownership. Section 33-82. Fees. A fee for review of a condominium or conversion condominium plat shall be charged as provided herein for review of a sub- division plat. A fee for processing additional use permit or variance, if applicable, shall be charged in an ~ount equal to the fee set for use permits or variances by this Code. In addition, the City may impose such charges and fees on conversion condominiums as are lawfully imposed as the result of new structures to the extent that such charges and fees, or portions thereof, imposed upon the property subject to such conversion condominium may be reasonably related to greater or additional services to be provided by the City as a result of the conversion condominium. 4. That Section 40-31 of the Code of the City of Ports- mouth, Virginia, 1973, be amended by changing the definition of. group housing project to read as follows: Section 40-31. Definition. GROUP HOUSING PROJECT. A group housing project shall consist of more than one residential unit on a site where the building arrangement as proposed is such that the property cannot be subdivided into conventional streets and lots that meet the requirements of this Chapter and the Subdivision Chapter of the City.
