ARTICLE VI. Condominiums <br /> <br />Section 33-80. Submission of plats. <br /> <br /> Condominiums and conversion condominiums as defined here- <br />in, shall be required to submit to the Planning Commission <br />condominium or conversion condominium plats prepared in accord- <br />ance with §55-79.58 of the Code of Virginia and a copy of all <br />documents filed with the'Virginia Real Estate Commission. Said <br />plat and documents shall be subject to approval as required by <br />this Chapter for subdivision plats. <br /> <br />Section 33-81. Conformity to zoning and land use. <br /> <br /> No condominium or conversion condominium shall be approved <br />by the Planning Commission which does not conform to the zoning, <br />land use, and site plan requirements and regulations of the Code <br />of the City of Portsmouth for the property on which such structure <br />is located until such time as the declarant of the condominium <br />shall secure such use permit or variance as may be applicable <br />under the Portsmouth City Code for similar property under a ~ ~ <br />different form of ownership. <br /> <br />Section 33-82. Fees. <br /> <br /> A fee for review of a condominium or conversion condominium <br />plat shall be charged as provided herein for review of a sub- <br />division plat. A fee for processing additional use permit or <br />variance, if applicable, shall be charged in an ~ount equal to <br />the fee set for use permits or variances by this Code. In <br />addition, the City may impose such charges and fees on <br />conversion condominiums as are lawfully imposed as the result <br />of new structures to the extent that such charges and fees, or <br />portions thereof, imposed upon the property subject to such <br />conversion condominium may be reasonably related to greater or <br />additional services to be provided by the City as a result of <br />the conversion condominium. <br /> <br /> 4. That Section 40-31 of the Code of the City of Ports- <br />mouth, Virginia, 1973, be amended by changing the definition of. <br />group housing project to read as follows: <br /> <br />Section 40-31. Definition. <br /> <br /> GROUP HOUSING PROJECT. A group housing project shall consist <br />of more than one residential unit on a site where the building <br />arrangement as proposed is such that the property cannot be <br />subdivided into conventional streets and lots that meet the <br />requirements of this Chapter and the Subdivision Chapter of the <br />City. <br /> <br /> <br />
