AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 33-2, 33-3, 40-31, AND <br />40-55, AND BY ADDING TO CHAPTER 33 THEREOF, ARTICLE VI <br />PERTAINING TO CONVERSION CONDOMINIUMS AND GROUP HOUSING <br />PROJECTS. <br /> <br /> BE IT.ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That Section 33-2 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended by adding thereto, <br />the definition of conversion condominium to read as follows: <br /> <br />Section 33-2. Definition. <br /> <br /> CONVERSION CONDOMINIUM. A conversion condominium shall <br />mean a condominium containing structures, which before the <br />recording of the declaration, are wholly or partially occupied <br />by persons other than those who have contracted for the <br />purchase of condominium units-and those-who occupy with the <br />consent of such purchasers and where undivided interest in <br />the common elements are vested in the unit owners. <br /> <br /> 2. That Section <br />mouth, Virginia, 1973, <br />follows: <br /> <br />33-3 of the Code of the City of Ports- <br />be amended and reordained to read as <br /> <br />Section 33-3. <br /> <br />Preparation and recordation of subdivision <br />plats. <br /> <br /> (a~ Any owner or proprietor of any tract of land, any <br />condominium or conversion condominium, which is located withLn <br />the City, who subdivides such tract or condominiums or con-- <br />version condominiums subsequent to approval by City Council, <br />or who causes any streets, alleys or public areas to be created, <br />shall cause a plat to be made of such subdivision and streets, <br />alleys and public areas, shall also cause such plat to be <br />recorded in the Office of the Clerk of the Circuit Court of <br />the City. Such plat shall be prepared in accordance with the <br />requirements of this Chapter except that condominiums or <br />conversion condominium plats shall be prepared in accordance <br />with ~55-79.58 of the Code of Virginia, and a copy of all <br />documents filed with the' Virginia Real Estate Commission shall <br />also be filed with the Planning Director. <br /> <br /> 3. That Chapter 33 of the Code'of the City of Portsmouth, <br />Virginia, 1973, be amended by adding thereto Article VI, such <br />Article to read as follows: <br /> <br /> <br />
