AN ORDINANCE CLOSING A PORTION OF FAIP~A~ AVE_~E. <br /> <br /> ~EREAS, the City of Portsmouth, Virginia has made appli- <br />cation to vacate, close and discontinue the hereinafter-described <br />portion of Fa~rfax Avenue; and <br /> <br /> ~tEREAS, by a resolution adopted by the Council of the City <br />of Portsmouth on July 12, 1983, viewers were appointed pursuant <br />to ~15.1-364, Code of Virginia, 1950, as a~ended, to view the <br />hereinafter-described portion of Fairfax Avenue, and to report <br />in' writing Whether in thei~ opinion any, and if any, what in- <br />convenience Would result from discontinuing the said street~ <br />and <br /> <br /> WHEREAS, said viewers have reported in writing that in <br />their opinion no inconvenience would result from the closing <br />and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia that the hereinafter-described portion <br />of Fairfax Avenue be closed and vacated as a public street. <br /> <br />FAIRFAX AVE~TUE <br /> <br /> All that portion of Fairfax Avenue beginning on <br />the northern boundary of Portsmouth Boulevard and ex- <br />tending to the southern boundary of Watts Avenue. <br />(S-83-9). <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth reserves <br />unto itself perpetual easements, rights and privileges to install, <br />operate an~ maintain electric lines, sewer mains, sewer drains, <br />sanitary sewers, storm drains, water mains and laterals within, <br />over, under and across the hereinabove-described portion of said <br />street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia <br />at a meeting held September 27, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
