83-134 <br /> <br />April 21, 1983 ~04 3~3-S641 <br /> <br />Dear <br /> <br /> A proposal has'been presented to ~he Portsmouth City Council <br />for changes to the City's Taxicab Ordinance. Prior to taking formal <br />action, City.'Council requested that I share with you the proposed <br />changes and solicit your comments and recommendations. <br /> <br /> The following is a listing of the proposed changes along <br />with-a brief explanation: <br /> <br />Section 37-2 Violations of the Taxicab Ordinance are <br />currently published as Class I m~sdemeanors which means <br />that if found guilty the owner or the operator of the <br />taxicab could be fined up to $1~000 and/or 3ailed for <br />up to twelve months. Based on recommendations from the <br />Chief of Police and the Clerk of the General District <br />Court it is proposed that the classification be. reduced <br />to a Class !II misdemeanor in all instances except two. <br />The two provisions which would remain Class I misdemeanors <br />would be those pertainlng to alcoholic beverages and intoxi- <br />cation. For your information a Class Iii misdemeanor carries <br />a maximum penalty of up to $500 (no jail sentence). <br /> <br />Section 37-22 - Currently the City requires that cab <br />operators or owners carry sufficient liability insurance. <br />The proposed change would clarify when and how the fact of <br />insurabilitl; is commmnicated to the City (at time of renewal). <br /> <br /> Section 37-24 C~rrently the City does not allow for a <br /> station wagon to be used as a taxicab. The proposed code <br /> change would allow for station wagons where %he vehicle <br /> otherwise complies with the requirements of the tax~cab <br /> ordinance. <br /> <br /> <br />
