_AN ORDINANCE TO D~iEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS ~ENDED~ BY ~ENDING SECTIONS 37-1, 37-2, 37-22, 37-24, 37-25p 37-29~ 37-3~, 37-39 AND 37-50 THEREOF, PERTAINING TO TAXICABS. BE iT ORDAINED by the Council of the City of Portsmouth, Virginia, that Sections 37-i~ 37-2~ 32-22, 37-24, 37-25, ~37-29, 37-38, 37-39 an~ 37-50 of the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: Section 37-i. Use of offensive language by operator. If any insulting, offensive~ obscene, profane, or threatening language is used toward or in the presence of any passenger by the driver or operator of an automobile or other vehicle transporting passengers for pay, the court or jury trying the offense may~ in addition to imposing the general penalty for a Class 3 Misdemeanor, declare the license or permit of such person revoked. Section 37-2. Penalty. Wherever in Article i or Article-II of this Chapter any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in Article I or Article II of this Code, the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, where no specific penalty ms provided therefor~ the violation of any such provision of Article I or Article ~I of this Chapter or of any such ordinance, rule or regulation shall be punished as a Class 3 l~isdemeanor, the penalty for which is provided for in ~21-2 lc) of this Code% Each and every day any such Article II of this Chapter shall a separate offense. violation of Article I or continue, shall constitute Section 37-22. Liability insurance. No taxicab shall be operated on the streets of the City unless the ox~ner and driver are protected by liability in- surance issued by a company authorized to do business in the State in the s~m of such amounts now required by the State Corporation Co~ission and the requirements of the Virginia Motor Vehicle Safety Responsibility Act. Both the owner and the driver shall furnish proof deemed sufficient to the City Manager or his duly authorized agent prior to the issuance of any license, charter or certificate required by this Article and at such tL~es and places as the City Manager or his duly authorized agent may require and on an annual basis at the time of the renewal of such insurance.
