AN ORDINanCE TO D~ND ARTICLE ii OF CHAPTER 21 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGiNiA, 1973, AS AMENDED, BY ADDING THERETO~ SECTIONS 21-18.1 ~D 21-18.2 PERTAINING TO IMITATION CONTROLLED SUBSTANCES BE IT ORDAINED by the Council of the City of Portsmouth, Virginia~ that Article II of Chaoter 21 of the Code of the City of Portsmouth~ Virginia~ 1973~ as amended, be amended by adding thereto~ Sections 21-i8~i and 21-18.2, such sections to read as fo!iowa, s: Section 21-18~1~ Selling of imitation controlled substances. It shall be unlawful for any person to setl, give, or otherwise distribute to any person unSer the age of eighteen (18) years of age any imitation ~ontrolled substance. The term "imitation controlled substance" shall mean any sub- stance other than a controlled substance or prescription drug, or combination of such substance which by representation or appearance (including, but not limited t~, name, color, shape, size and markings) would lead a reasonable person to believe that the substance is a controlled substance, or which purports to act, either aione~ in multiple doses, or in co~ination with a substance or s~!bstances, like a contrclled substance, either stimulant or depressant. Any person violating the provisions of this section shall be guilty of a class 1 misdemeanor. Section 21-18.2. Selling of imitation controlled substance constitutes a nuisance. The sale or distribution of any imitation controlled sub- stance, as defined in Section 21-18.1, to a person under the age of eighteen (18) years of age, shall constitute a nuisance detrimental to the health, safety, and welfare of the residents of the City. 2. This ordinance shall take effect as of the date of its adoption. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held August 9, 1983. Teste: City Clerk
