83-2 AN ORDINANCE TO k~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1913, BY AMENDING SECTION 40-102 (I) THEREOF, PERTAINING TO HISTORIC LIMITED BUSINESS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1o That Section 40-102 of Portsmouth, Virginia, 1973, read as follows: (I) of the Code of the City be a~ended and reordained to Section 40-102. Historic and Subdistricts; Building Regulations. (I) Historic Limited Business: The following regulations shall apply to such Historic Limited Subdistricts as are established: (1) Uses shall be limited to those allowed in C-1 as prescribed in and for that zoning district and housing for the elderly and multi-family dwellings as prescribed in and for Historic Residential Subdistricts. (2) The Commission of Architectural Review may issue a certificate of appropriateness for alterations pro- posed in any subdistricts established on Afton Parkway in Cradock (February 10, 1976) and in the Limited Business District in Port Norfolk (April 26, 1983) and may alter required off- street parking and loading requirements. (3) The ComMission of Architectural Review may issue a certificate of appropriateness, and thereafter the building official may issue building and occupancy permits for residential dwelling units incorporated in structures where the principal use is commercial or semicommercial under terms of Commercial C-l; provided that a dwelling unit containing one bedroom, shall in- corporate no less than four hundred (400) square feet of usable floor area therein, a dwelling unit with two (2) bedrooms no less than seven hundred (700) square feet and a dwelling unit with three bedrooms no less than eight hundred (800) sauare feet. 2. This ordinance shall take effect as of the date of its adoption. Adopted by the Council of the City of Portsmouth, Virginia at a meeting held June 28, 1983. Teste: City Clerk
