Be it resolved by the Council of the City of Portsmouth, Virginia, that it is necessary for the City to acquire the fee simple title in and to the follow- ing described tract of land, together with a temporary construction easement in and to adjoining land, for use in the widening and improvement of Elm Avenue, Project 0017-124-101, the record title to said property being in the name of Gulf Refining Company: Fee Taking (Parcel 006) Beginning at a point which is the northeasterly intersection of County Street and Elm Avenue; thence in a northerly direction along the easterly pro- perty line of Elm Avenue for a distance of one hundred thirteen (113) feet to a point; thence in an easterly direction along the dividing line between lots l0 and 36 for a distance of fifteen (15) feet to a point; thence southerly along a line, which is parallel to and fifteen (15) feet distant from the easterly pro- perty line of Elm Avenue, for a distance of one hundred thirteen (ll3) feet to a point; thence in a westerly direction along the northerly property line of County Street for a distance of fifteen (15) feet to the point of beginning. Construction Easement The right to enter upon the following described property, for a period not to exceed two (2) years from the date of taking, for the purposes of grade adjustment, placing of construction forms and other work incident to the project of widening and improving Elm Avenue: Beginning at a point on the dividing line between the aforesaid lots l0 and 36, said point being fifteen (15) feet distant from the easterly line of Elm Avenue; thence southerly, parallel to and fifteen (15) feet distant from the easterly line of Elm Avenue one hundred thirteen (I13) feet to a point on the northerly line of County Street; thence easterly along said line two (2) feet; thence in a northerly direction eighty-four (84) feet more or less, to a point, said point being sixteen and five-tenths (16.5) feet east of the easterly tine of Elm Avenue, thence northerly twenty-nine (29) feet more or less, to a point on the dividing line between lots l0 and 36; thence in a westerly direction along said line two and one-tenth (2.1) feet to the point of beginning. Be it further resolved that the City Attorney is authorized and instructed to institute condemnation proceedings to acquire the aforesaid property and rights in property for the purposes of the City, This is to certify that the foregoing is a true and correct copy of a reso- lution adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on October 27, 1959. __________________________________ City Clerk
