Be it resolved by the Council of the City of Portsmouth, Virginia, that it is necessary for the City to acquire the fee simple title in and to the following described tract of lands together with a temporary construction ease- ment in and to adjoining land, for use in the widening and improvement of Elm Avenue, Project 0017-124-101, the record title to said property being in the name of Stokely Realty Corporation: Fee Taking (Parcel 007) Beginning at a point which is the northwesterly intersection of Elm Avenue and County Street; thence in a westerly direction alone the northern property line of County Street for a distance of fifteen (15) feet to a point; thence in a northerly direction along a line, which is parallel to and fifteen (15) feet dis- tant from the westerly property line of Elm Avenue, for a distance of one hundred thirteen (113) feet to a point; thence in an easterly direction alone the dividing line between lots 11 and 37 for a distance of fifteen (15) feet to a point on the western property line of Elm Avenue; thence in a southerly direction along the westerly property line of Elm Avenue for a distance of one hundred thirteen (113) feet to the point of beginning. Construction Easement The right to enter upon the following described property, for a period not to exceed two (2) years from the date of taking, for the purposes of grade adjust- ment, placing of construction forms and other work incident to the project of widening and improving Elm Avenue. Being the westerly two (2) feet of land adjacent and parallel to the new proposed right of way line for the Elm Avenue widening. Said strip beginning at the dividing line between lots 11 and 37 and terminating at the northern property line of County Street. Said easement lying entirely within lot #37. Be it further resolved that the City Attorney is authorized and instructed to institute condemnation proceedings to acquire the aforesaid property and rights in property for the purposes of the City. This is to certify that the foregoing is a true and correct copy of a resolution adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on October 27, 1959. __________________________________ City Clerk
