Be it resolved by the Council of the City of Portsmouth, Virginia, that <br />it is necessary for the City to acquire the fee simple title in and to the <br />following described tract of land, together with temporary construction and demo- <br />lition easements in and to adjoining land, for use in the widening and improve- <br />ment of Elm Avenue, Project 0017-124-101, ths record title to said property being <br />in the names of Albert L. Tweed and William M. Molbrook: <br /> <br /> Fee Taking (Parcel 002) <br /> <br /> Beginning at a point which is the southeasterly intersection of King Street <br />and Elm Avenue; thence easterly along the southern property line of King Street <br />for a distance of twenty-nine (29) feet to a point; thence southwesterly for a <br />distance of nineteen and eighty hundredths (19.80) feet to a point; thence south- <br />erly along a line which is parallel to and fifteen (15) feet distant from the <br />easterly property line of Elm Avenue, for a distance of ninety-nine (99) feet to <br />a point; thence westerly along the property line between lots 10 and 36 for a <br />distance of fifteen (15) feet to a point; thence northerly along the eastern pro- <br />perty line of Elm Avenue for a distance of one hundred thirteen (ll3) feet to <br />the point of beginning. <br /> <br /> Together with the one story building situated partly upon the aforesaid <br />Parcel 002 and partly upon property lying adjacent thereto to the east, <br /> <br /> Construction Easement <br /> <br /> The right to enter upon the following described property, for a period <br />not to exceed two (2) years from the date of taking, for the purposes of grade <br />adjustment, placing of construction forms and other work incident to the project <br />of widening and improving Elm Avenue: <br /> <br /> Beginning at a point on the dividing line between Lots 10 and 36, fifteen <br />(15) feet east of the easterly line of Elm Avenue; thence northerly along a line <br />parallel to and fifteen (15) feet from the easterly line of Elm Avenue ninety- <br />nine (99) feet to a point; thence in a northeasterly direction three (3) feet, <br />more or less; thence in a southerly direction eighty (80) feet, more or less, to <br />a point, said point being seventeen and five-tenths (17.5) feet from the easterly <br />line of Elm Avenue; thence southerly twenty-one (21) feet, more or less, to a <br />point, said point being located on the dividing line between said lots 10 and 36 <br />and seventeen and one-tenth (17.1) feet from the easterly line of Elm Avenue; <br />thence along said divlding line in a westerly direction two and one-tenth (2.1) <br />feet to the point of beginning. <br /> <br /> Demolition Easement <br /> <br /> The right to enter upon the adjoining property of the aforesaid persons, <br />for a period not to exceed one year from the date of taking, for the purpose of <br />demolishing and removing the aforesaid building partly situated thereon. <br /> <br /> Be it further resolved that the City Attorney is authorized and instructed <br />to institute condemnation proceedings to acquire the aforesaid property and rights <br />in property for the purposes of the City. <br /> <br /> This is to certify that the foregoing is a true and correct copy of a re- <br />solution adopted by the Council of the City of Portsmouth, Virginia, at a meeting <br />held on October 27, 1959. <br /> <br /> _____________________________________ <br /> City Clerk <br /> <br />
