~ 3[08. Vacancies in the Offices of Mayor or Vice-Mayor. <br /> <br /> Vacancy in the o_f~_ce of the mayor o~ vice-mayor~ from <br />whatever cause arising~ shall be filled by ma~ority~ vote of alt <br />the members of the council for the unsxpired portion of the term. <br /> <br />§ 3.09. Duties of Mayor. <br /> <br /> The mayor shall preside over the meetings of the council <br />and shall have the same right to vote and speak therein as other <br />members of council. He shall be recognized as the head of the <br />city government for all ceremonial purposes~ the purposes of mil- <br />itary law, and the service of civil process. In the absence or <br />disability of the mayor~ the vice-mayor sh&ll perform the duties <br />of mayor. <br /> <br />§ 3.10. Compensation of the Mayor and Council. <br /> <br /> The city council out of the general funds of the city, <br />shall grant and pay to the mayor the sum of two hundred and fifty <br />dollars per month end,to the other members of the city council the <br />su~ of two hundred dollars per month each. <br /> <br />§ 3.11. Councilmen Prohibited From Furnishing City Anything Requiring <br /> Paymenz. <br /> <br /> No member of the city council shall be allowed to furnish <br />any g6ods or services to the city for which he receives any consid- <br />eration in money or otherwise~ either directly or indirectly~ under <br />penalty of the forfeiture of his office as council~an~ as well as <br />forfeiture of the consideration involved; and any person making <br />under oath, a charge of this nature before any judge of the court <br />o£ hustings shall cause the accused councilman to show cause why <br />he should not be removed; and if such charge is sustained~ the <br />said judge shall remove him from office at once. <br /> <br />3.12. Council Not to Inter~ere in Appointments or Removals. <br /> <br /> Neither the council nor any of its members shall direct <br />or request the appointment of any person to or his removal from <br />any office or employment by the city manager or by any of his <br />subordinates or in any way take part in the appointment of or <br />removal of officers and employees of the city except as ~pecificalty <br />provided in this charter. Except for the purpose of inquiry, the <br />council and its members shall deal with the administrative ser- <br />vices solely through the city manager, and neither the council <br />nor any member thereof shall give orders either publicly or pri- <br />vately to any subordinate of the city manager. Any councilman <br />violating the provisions of this section or voting for a motion, <br />resolution or ordinance in violation of this section shalt be <br />guilty of a misdemeanor and upon conviction t~ereof shall cease <br />to be a councilman. <br /> <br />-I1- <br /> <br /> <br />
