A RESOLUTION GRAYLING A USE PE~.~f FOR Tk~ OPE~&TION OF A S~AGE PbT~ING STATION AT THE INTERSECTION OF THE I~YfERSTATE 264 SERVICE ROAD AMD ~HE ~S~EP~N PROPERTY LIE OF T~ LA~-I~ ELE~-~fARY SCHOOL SITE, UP-69-19. ~REAS, Cavalier Estates Development Corporation has made an application pursuant to Sectiom 4-2 of the Zoning Ordinance of the City of Ports~outh, 1961, for the granting of a use permit as hereinafter described; and ~REAS, the applicant, the Plannimg Director and the City Manager have done all things required te be done im connect~om with said application, and the Planning Commission b~s recomended the ~ranting of said use permit, subject to the conditions here~mafter stated. Ng~, THEREFORE, BE IT RESOLVED by the Comncil of the City of Portsmouth, Virginia; That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or work- lng in the neighborhood of the proposed use, (2) ~ilt not be detrimental to the public welfare or injurious to property or improvements im the neighborhood, and (3) will be in accord with the purposes of said Zoning Ordinance. That Cavalier Estates Development Corporation is hereby gr~nted a use p~ermit, subject to site plsn restrictions, pursusnt to Section 4-2 of said Zoning Ordinance, for the operatiom of a sew@ge pumping station located on the property described as follows: Beginning at the intersection of the west property line of Lakeview Elementary School ~th the south right-of-way line of the Interstate 264 service road; thence southwest along a curw'e 46.4 feet;' thence southeast 50 feet; thence northeast 40 feet to said school property line; thence northwest 73.5 feet to the point of origin.
