A RESOLUTION GP~_NTING A USE PEP~ET FOR ~HE OPERATION OF AN AUDDMOT/VE SERVICE STATION AT TP~ CORN~ OF QUEEN STRa~'f ;2~D I-IAT,I-~ AV~3E, UP-70-3 WHEREAS, Tinee Giant Properties Corporation has made an ap- p~Ii_cat~ion pursuant~ to Section 4-2 of. the zoning ~ce of the City i. or ~orcsmouth, 1981, for the granting of a use Peri'It as hereinafter describedl and ' WHEREAS, the applicant and the Ptauning Director have done s]l things required to be done in connection with said application, and the Planning Commission has recon~mended the grsntir~ of said use permit, subject to the conditions hereinafter stated. NOW, ~HEREFORE, BE IT RESOLVED by the Council of the City of PortSmOUth, Virginia; That the use for ~nich the use pezmvit hereinafter described is sought (i) will not adversely affect the health or safety of' persons residing or work- Lng in the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood, and (3) ~ll be in accord v~th the purposes of said Zoning Ordinance. That Tinee Giant Properties Corporation is hereby granted a use permit, subject to site plan restric- tions, pursuant to Section 4-2 of said Zoning Ordi- nance, for the operation of an autc~otive service station located on the property described as fol- lows: ~eginning at the northeast corner of Queen Street and Halifax Avenue; thence rum_r~ng East along Queen Street 140 feet; thence No~h 112.18 feet %o the'Sea- board Coast Line Railroad; thence West along said railroad right-of-way 140.23 feet to Halifax Avenue; thence South !11.7~ feet to the point of origin.
