A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREemENT WITH THE SEABOARD COAST LINE RAILROAD CO~PANY CON- <br />CERNiNG THE ASSIG~ENT OF THE RAILROAD'S RIGHTS AND INTEREST <br />TO A CERTAIN EAS~ENT HEt~D BY Ti~ VIRGINIA DEPARTMENT OF HiGH- <br />WAYS W~H!CH SA~D EASF~4ENT IS LOCATED WITHIN A CERTAIN TRACT OF <br />LAND TO BE CONVEYED TO THE CiTY OF PORTSMOUTH BY THE SEABOARD <br />COAST LINE PJ~ILRO~ COMPANY. <br /> <br /> ~HEREAS~ the Seaboard Coast Line Railroad Company <br />has agreed to deed a certain tract of land consisting of <br />1.481 acres~ more or less~ to the City of Portsmouth; and <br /> <br /> WHEREAS~ prior to said conveyance~ the Railroad <br />Company by indenture dated August 15~ 1972, granted to the <br />Virginia Department of Highways of the Co~monweaith of Vir- <br />ginia, a right of way and easement for construction work <br />purposes, incident to the construction of the Crawford Street <br />Connector~ on and over a portion of said 1.481 acres of <br />land; and <br /> <br /> ?~EREAS~ the Railroad Company and the City of Ports- <br />mouth mutually desire that the Railroad Company assign its <br />rights and interest in said easement to the City of Portsmouth. <br /> <br /> NOW, T~REFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, in a regular meeting assembled <br />that the City Manager of said City be, and he hereby is, author- <br />ized to enter into an agreemen~ with the Seaboard Coast Line <br />Railroad Company~ and to sign se~me on behalf of said City where- <br />by said Railroad Company grants unto said City its rights and <br />interest in said easement as set forth in the hereinabove men- <br />tioned agreement a copy of which agreement is filed with this <br />City Council. <br /> <br /> Adopted by the Councit of the City of Portsmouth, <br />Virginia, at a meeting held August t4~ 1973. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
