A RESOLUTION EXPRESSING THE STRONG OPPOSITION OF THE COUNCIL OF <br />THE CITY OF PORTSMOUTH, VIRGINIA, TO A PROPOSED CHANGE BY THE <br />STATE AIR POLLUTION CONTROL BOARD OF ITS "REGULATIONS FOR THE <br />CONTROL AND ABATEMENT OF AiR POLLUTION," WHICH SAID CHANGE <br />WOULD PROHIBIT THE CONSTRUCTION OR MODIFICATION OF ANY STRUCTURES <br />CLASSIFIED AS POSSIBLE AIR POLLUTION SOURCES OR COMPLEX AIR POLLU- <br />TION SOURCES WITHOUT PRIOR APPROVAL OF BASIC POLLUTION CONTROL <br />DESIGN AND THE ISSUANCE BY THE BOARD OF A PERMIT THEREFOR. <br /> <br /> WHEREAS, pursuant to rule making power granted by <br />Section 10-17.18 of the Code of Virginia, 1950, as amended, the <br />State Air Pollution Control Board shall consider at a public <br />hearing on August 6, 1973, a proposed change to its "regulations <br />for the control and abatement of air pollution" which would pro- <br />hibit the construction or modification of any structure which <br />would harbor or produce a possible air pollution source or com- <br />plex air pollution source as defined by said regulations with- <br />out first obtaining approval of the basic pollution control <br />design of such structure and the issuance by the Board of a <br />permit therefor; and <br /> <br /> WHEREAS, the effect of the adoption of such proposed <br />change would be to deprive the municipality of the complete and <br />ultimate authority to approve the construction or modification <br />of facilities and the issuance of permits therefor; and <br /> <br /> WHEREAS, it is the sense of the Council that the adop- <br />tion of said proposed change would be inimical to local control <br />of construction and community development, such local control <br />being imperative to the rapid, efficient and proper development <br />of the subject community; and ' <br /> <br /> WHEREAS, it is the sense of the Council that the adop- <br /> tion of said proposed change would inordinately slow the con- <br /> struction of new housing and industry in the City of Portsmouth <br /> at a time when such construction is critical to the future well- <br /> being of the City; and <br /> <br /> WHEREAS, it is the sense of the Council that the adop- <br /> tion of such proposed change would create a procedure which would <br /> exclude from the construction review and planning process the <br /> consideration of local conditions; and <br /> <br /> WHEREAS, it is the sense of the Council that a better <br /> method of prompting pre-construction review of possible air pol- <br /> lution sources would be by encouraging the adoption of adequate <br /> local air pollution ordinances pursuant to Section 10-17.30 of <br /> the Code of Virginia, 1950, as amended. <br /> <br /> <br />
